Terms of Use

These terms govern use of The Simulator Tour website, accounts, registration, and competition services.

1. Acceptance of these terms

By accessing this website, creating or using a Competitor Hub account, submitting a facility application, registering for a competition, or otherwise using The Simulator Tour services, you agree to these Terms of Use and the policies incorporated into them. “TST,” “we,” “us,” and “our” refer to The Simulator Tour, operated through 4th Groove Golf for the applicable competition.

If you do not agree, do not use the services or submit a registration.

2. Eligibility

You must be legally able to enter into these terms. A participant under 18 must have a parent or legal guardian complete or approve the registration and accept responsibility for the participant’s compliance. TST may establish additional eligibility requirements for a specific tour, event, facility, jurisdiction, or division.

3. Accounts and information

You are responsible for providing accurate registration, contact, facility, and Simulator Golf Tour information. You may not use another person’s identity, SGT account, scorecard, or Competitor Hub account. You are responsible for maintaining access to your email and for protecting account links and credentials.

TST may correct obvious profile errors, merge duplicate records, suspend access, or request verification when reasonably necessary to protect the platform or competition.

4. Registration fees and payment

Competition entry fees are displayed before checkout and are processed securely through Stripe by 4th Groove Golf on behalf of The Simulator Tour. Simulator-bay time, memberships, travel, equipment, internet access, and other facility charges are separate unless expressly stated otherwise.

Refund eligibility is controlled by the Refund Policy. A payment dispute or chargeback does not automatically cancel a competition result, account obligation, or rule decision.

5. Competition participation

Participation is also governed by the applicable tour details, the Competition & Participation Policy, and the published Competition Rules. Those materials address deadlines, official scoring, handicaps, qualification, technical failures, replays, payouts, ties, conduct, and administrative decisions.

SGT is the official source for scores, handicaps, Gross and Net standings, points, and event results unless TST expressly announces a correction or alternative procedure.

6. Acceptable use and conduct

You may not interfere with the website, attempt unauthorized access, submit malicious code, scrape private data, impersonate another person, manipulate competition data, abuse payment systems, harass participants or facilities, or use TST branding in a misleading way. TST may suspend or remove access, invalidate entries, disqualify results, or take other reasonable action to protect participants and the platform.

7. Third-party services

TST relies on independent services including SGT, GSPro, Stripe, Supabase, Resend, Netlify, launch-monitor providers, and partner facilities. Their services, terms, availability, privacy practices, and equipment are not controlled by TST. Links to third-party services are provided for convenience and do not create ownership, endorsement, or responsibility beyond what TST expressly states.

8. Service availability and changes

We may modify, pause, replace, or discontinue website features, schedules, formats, qualification procedures, or administrative tools when reasonably necessary. Material competition changes will be communicated through the website, email, Competitor Hub, or another appropriate channel. We do not guarantee uninterrupted access to the website or any third-party platform.

9. Content and publicity

You retain ownership of content you submit. You grant TST a nonexclusive license to use submitted names, usernames, scores, standings, profile information, facility information, and approved images to operate, administer, display, and promote the competition platform. TST will not use private account information for public promotion unless it is part of the public profile or you otherwise authorize it.

10. Disclaimers and limitation of liability

The services are provided on an “as available” basis. To the fullest extent permitted by law, TST disclaims implied warranties and is not responsible for indirect, incidental, special, consequential, or punitive damages arising from platform outages, third-party services, equipment, facility conditions, travel, lost opportunities, or competition participation. Nothing in these terms excludes liability that cannot legally be excluded.

Golf and simulator activity involves physical movement and equipment. Participants are responsible for using appropriate care, following facility rules, and deciding whether they are physically able to participate.

11. Responsibility for your actions

To the extent permitted by law, you agree to be responsible for claims, losses, or costs caused by your unlawful conduct, rule violations, misuse of the services, infringement of another person’s rights, or breach of these terms.

12. Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute must be brought in a court with proper jurisdiction in Texas unless applicable law requires otherwise.

13. Changes to these terms

We may update these terms. The updated date will appear at the top of this page. Continued use after an update constitutes acceptance of the revised terms, except where additional notice or consent is required by law.
